The Graduate School of Business and Entrepreneurship, in collaboration with the Asian Development Bank, is hosting a practical seminar on the application of alternative dispute resolution methods for commercial disputes.  

 On November 12, 2024, a two-day practical seminar is being held at the Graduate School of Business and Entrepreneurship, focusing on alternative dispute resolution in commercial matters for representatives of private businesses, economic associations and government agencies.

The seminar includes prominent international experts from Italy, Germany, and Poland, as well as local specialists in alternative dispute resolution from leading arbitration and mediation institutions in Uzbekistan.

It is important to note that, in the context of improving the business environment and enhancing business operations in Uzbekistan, one of the key issues is the development of an effective system for applying alternative means of resolving disputes arising in entrepreneurial activities.

A crucial aspect of improving alternative dispute resolution methods is addressing commercial disputes through arbitration, which elevates the culture of business relationships within the business community and fosters trust among partners in settling various commercial issues and conflicts. Today, this form of alternative dispute resolution stands out as one of the most effective tools for resolving private law matters.

As the sphere of entrepreneurship expands, the business interactions among entities are increasing not only in the domestic market but also on an international level. Entrepreneurs are interested in swift and independent resolutions to commercial disputes and contradictions that arise during their business activities.

On the first day of the seminar, participants examined, based on international arbitration practices, the conditions for applying arbitration agreements between parties, the nuances of resolving disputes through arbitration, and essential conditions for incorporating arbitration clauses into contracts.

Furthermore, drawing from international experience, participants discussed approaches to addressing potential disputes in investment agreements between parties, strategies for preparing to resolve contradictions in commercial disputes using modern business approaches and studied key terms and provisions necessary for inclusion in investment contracts to resolve potential disputes.

During the seminar, attendees also explored national peculiarities of resolving commercial disputes in Uzbekistan, current legislation regarding arbitration and mediation of commercial disputes, as well as the conditions for addressing contradictions and commercial conflicts in arbitration courts.
