International Conference: “Opportunities and Challenges in Cross-Border Disputes Resolution”

On November 22, 2024, the Graduate School of Business and Entrepreneurship hosted an international conference titled Opportunities and Challenges in Cross-Border Disputes Resolution. The event was organized by the Graduate School, the China International Economic and Trade Arbitration Commission (CIETAC), and the Tashkent International Arbitration Center (TIAC) under the Chamber of Commerce and Industry of Uzbekistan.

The aim of the conference was to facilitate the resolution of commercial disputes involving Chinese companies and to emphasize effective management of legal risks in the context of rapidly developing trade and economic cooperation between Uzbekistan and China. In 2023, trade turnover between the two countries reached $13.7 billion, underscoring the relevance and importance of such discussions.

During the conference, experts discussed recent updates to China's commercial arbitration system aimed at increasing transparency and efficiency in dispute resolution. The new provisions of the CIETAC rules were reviewed, highlighting their adaptation to international standards and practical application in cross-border commercial disputes.

Special attention was given to the interaction between Uzbekistan and China in the field of arbitration. Participants shared experiences in resolving disputes, identified key challenges related to legal differences, and provided recommendations for strengthening cooperation. An analysis of specific cases involving disputes that cannot be resolved through arbitration was also presented, with a focus on their legal implications.

Economic sanctions and restrictions were identified as significant factors impacting arbitration proceedings. Participants noted how such measures complicate the processes of recognition and enforcement of awards and proposed strategies for addressing these challenges within the legal framework.

Experts also discussed the successful and problematic aspects of applying CIETAC decisions in Uzbekistan. The discussions focused on the processes for recognizing such decisions in local courts and their alignment with Uzbekistan's legal framework.

The conference brought together government officials, legal experts, business representatives, and attendees interested in developing effective mechanisms for resolving cross-border disputes. It served as a vital platform for sharing experiences and addressing practical issues related to the legal aspects of trade and economic relations.
